TERMS AND CONDITIONS OF OFFERS

Unless otherwise stated in writing, these General Terms and Conditions apply to all training offered by BUREAU VERITAS INSPECCIÓN Y TESTING, S.L. Unipersonal (Tax Id. No. B08658601), hereinafter BVIT, with registered office at Camí Can Ametller 34, Edificio Bureau Veritas, 08195 San Cugat del Vallès, trading as Bureau Veritas Formación, offered through the website www.bureauveritasformacion.com.

TERMS AND CONDITIONS FOR THE PROVISION OF SERVICES

The provision of services undertaken by BVIT is, in general, without prejudice to those services that may be contracted ad hoc, the delivery of training programmes in open or scheduled sessions, provided either alone or in collaboration with other entities.

The services shall be provided under the terms, prices and circumstances, and in the form and manner as indicated in the product sheets published in the aforementioned website.

The training actions offered are published in a brochure and can be delivered face-to-face, online or by a combination of both.

REGISTRATION

Students must fulfil all entry requirements and submit all documents in the format requested within the established deadline in order to be enrolled in a course.

COURSE PLANNING

At the beginning of the training programme, students will receive a guide with all the information regarding planning, events, scheduling, assessments and deadlines. The Master's Degree Programmes, Advanced Programmes and University Expert Programs require continuous work with established deadlines for the completion and delivery of assessment activities. If, during the course of the training programme, for reasons of force majeure, the web service is suspended, preventing the completion of assessments, the tutor and the students shall agree new delivery dates.

TUTORING

Students are supported by tutors. Tutoring shall be conducted asynchronously on working days, according to the Spanish calendar, during office hours.

START DATES

In the case of Courses, Advanced Programs and University Expert Programs, after the first payment has been made and confirmed, a password will be sent to the e-mail address provided by the client within a maximum of 5 working days.

The Master's Degree programmes take place in sessions with dates locked-in in advance. Students must register 10 days prior to the start of the programme. The password shall be provided on the first day of class.

DIPLOMAS AND CERTIFICATES

The diplomas and certificates shall be sent to the students at the end of the course, once all the assessments have been successfully completed and all payments have been received.

The certificates and diplomas of Courses, Advanced Programs and University Expert Programmes shall be sent to the student in digital format. Students who wish to receive the diploma on paper must pay the issuance and shipping costs.

The Master's diplomas shall be issued on paper, and the students shall be charged the cost as indicated on the information sheet.

PRICE

The prices of the Courses, Advanced Programs, University Expert and Master Programs are those published on the bureauveritasformacion.com website. The price of each product is shown on the product information sheet on the website (retail price).

Additional costs are also detailed: issuance and shipping of diplomas, shipping of documentation, certificates, etc. All shipping costs are applicable to Spain. Students residing abroad must check to confirm the fees.

The sum of the training programme fees and the additional costs is the final price and no additional fees shall be added.

The prices published on www.bureauveritasformacion.com may be revised and updated at any time. The price applied at the time of purchase shall be valid. On certain dates, there may be discounts and promotions that reduce the retail price. However, these shall not be applied to additional costs.

Discounted prices and promotions are not cumulative with other offers and shall be applicable only during the period of validity of such discount or promotion. Students who do not complete the programme within the period established for the Master's Degree programme or who do not pass the assessment tests, will have to re-enrol in any outstanding courses of the relevant Master's Degree programme.

PAYMENT SCHEDULE

Depending on the duration of the training programme, payments may be made in instalments for Official Master's Degrees (9 monthly instalments, with the first being the registration fee), Non-Official Master's Degrees (11 monthly instalments, with the first being the registration fee) and Advanced Programs and University Expert Programs (in the last two cases, 6 monthly instalments of the same amount, with the first being the registration fee).

The registration fee (first instalment) shall be invoiced and paid before the start of the course. The following instalments shall be charged to the student's account and paid by direct debit monthly until the last instalment is paid.

REFUNDS AND CHANGES IN THE TRAINING PROGRAM

No refunds shall be accepted after payment has been made.

In the event that the wrong training programme was purchased by mistake, it may be exchanged for another one, provided that the password and/or course material have not been sent to the client.

The fact that the student or the company requests cancellation of the Course, Expert, Advanced Programme or Master's Degree during the training period does not exempt them from paying the full course fee.

NON-PAYMENT OF FEES

Late payment of invoices shall result in the application of late-payment penalties in accordance with Law 3/2004 of December 29, 2004, administrative costs, late-payment interest and bank fees for defaulting, if any. In accordance with the aforementioned Law, late-payment interest shall be the sum of the interest rate applied by the European Central Bank to its main refinancing operations as published in the Official State Gazette plus seven percentage points.

Persistent non-payment of fees shall result in the suspension of the service, and the student losing the right to restart the service or to obtain a diploma.

For face-to-face training programmes, cancellations made more than three days prior to the start of the programme shall be refunded 50% of the programme fee. No refunds shall be made for cancellations made three days or less before the start of the programme.

Any promotional item given at the time of purchase shall be returned in the event of non-payment of instalments.

TERMINATION OF THE CONTRACT AT THE CLIENT'S REQUEST

The contract for Master's Degree Programmes, Advanced Programs, University Expert Programmes or Courses is not indivisible and the service shall begin when the access codes have been sent to the student. However, if clients decide to terminate the contract unilaterally and without good cause attributable

TAXES

The training programmes offered in BVIT’s brochure are exempt from taxes.

JURISDICTION

The law applicable to BVIT contracts shall be Spanish law.

All disputes arising from the services provided, or those that may arise as a result of the interpretation of this contract shall be submitted to the Courts of Madrid, and any rights to another jurisdiction are expressly waived.

RIGHT OF WITHDRAWAL

You shall have the right to withdraw from the contract within 14 calendar days without justification, from the day the contract is signed, by means of the registration form.

To exercise the right of withdrawal, you must inform BVIT of your decision to withdraw from the contract by means of an unequivocal statement that you may send by e-mail to the following address administracion@bvbs.es. You may also complete and electronically submit the withdrawal form through our website www.bureauveritasformación.com. In this case, we shall inform you by e-mail of the receipt of such withdrawal.

In order to meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

CONSENT AT THE BEGINNING OF THE SERVICE AND LOSS OF THE RIGHT OF WITHDRAWAL

By signing the contract or registration form, you accept and consent that the provision of the teaching service covered by this contract may begin before the expiration of the withdrawal period, and since the training covered by the contract consists of digital content provided by electronic media. Commencement of the provision of services shall entail the loss of your right of withdrawal.

The provision of the service covered by the contract shall begin as soon as you receive an e-mail from BVIT with the username and password to access the electronic platform where the digital content of your course or Master's degree programme is hosted.

CONSEQUENCES OF WITHDRAWAL

In the event that you exercise your right of withdrawal, in accordance with the provisions of the two preceding paragraphs, we shall reimburse all payments made by you within 14 calendar days from the date you communicate your decision to withdraw from the contract. We shall make such reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly provided otherwise; in any case, you shall not incur any expenses as a result of the refund.
